However, in certain exceptional situations where no direct appeal lies, the Special Leave Petition (SLP) under Article 136 of the Constitution of India emerges as a crucial legal remedy. This extraordinary jurisdiction of the Hon’ble Supreme Court underscores the Court’s role as the guardian of justice, allowing it to intervene where substantial legal questions or miscarriage of justice are evident.

Special Leave Petition: Understanding The Mechanism
A Special Leave Petition is a mechanism through which the Hon’ble Supreme Court of India grants leave to appeal against any judgment, decree, determination, sentence or order passed by any court or tribunal in India (excluding military courts or tribunals). It is not a matter of right, but of judicial discretion. The phrase “special leave” indicates that the petitioner is requesting the Apex Court’s permission to be heard, despite no automatic right of appeal being available.
SLP: When To File?
A Special Leave Petition can be filed in both civil and criminal matters. A party aggrieved by the decision of a High Court (or tribunal) can approach the Hon’ble Supreme Court if there is a grave legal question, gross injustice, or violation of fundamental rights. However, the Court does not entertain SLPs merely because the petitioner lost a case; it requires a clear demonstration of legal significance or injustice.
Special Leave Petition : Format
Special Leave Petitions have to filed with accuracy and must strictly follow the format prescribed by the Supreme Court Rules, 2013 that state the following must be included in a Special Leave Petition:
- A synopsis and list of dates
- A statement of facts
- Grounds for seeking special leave
- A prayer for relief
- Essential documents such as the judgment challenged, certified copies, and affidavits must be annexed.
As per the Limitation Act, 1963, an SLP must be filed:
- Within 90 days from the date of judgment/order, or
- Within 60 days if a review petition was filed and rejected.
Delays beyond this period require a separate application for condonation, with a reasonable justification.

The Special Leave Petition is a vital legal tool that sustains the flexibility and responsiveness of the Hon’ble Supreme Court. Though not a routine remedy, its discretionary power plays a pivotal role in correcting grave judicial errors and upholding public confidence in justice.
